1. Formulating the Regulations on the Recovery, Return, and Job Placement of Drug Rehabilitation Personnel is necessary for the implementation of the Anti-drug Law of the People’s Republic of China and the Regulations on Drug Rehabilitation of the State Council. The Anti-drug Law of the People’s Republic of China is the basic law for national drug control. The fourth chapter concerning drug rehabilitation measures of the Anti-drug Law clearly stipulates that the country should adopt various measures to help drug addicts to get rid of drug addiction, and educate and save them. The public security authorities can order an drug addict to accept community-based drug rehabilitation, and notify the urban neighborhood offices and township people’s governments of the place where the drug addict’s residence is registered or the place of current domicile. The urban neighborhood offices and township people’s governments should be responsible for community-based drug rehabilitation work, and can designate relevant grassroots organizations, sign community-based drug rehabilitation agreements with drug addicts based on the situations of themselves and their families, and implement specific community-based drug rehabilitation measures. Public security, judicial administration, health administration, civil administration, and other authorities should provide guidance and coordination for community-based drug rehabilitation work. The urban neighborhood offices, township people’s governments, and the labor administration authorities of the county-level people’s governments should provide necessary vocational training, employment guidance, and employment assistance for drug rehabilitation personnel who have no jobs and lack employability. The Regulations on Drug Rehabilitation of the State Council also clearly stipulate that the civil administration, human resources and social security, education, and other authorities of the people’s governments above the county level should, based on their own responsibilities, provide guidance and support such as recovery and vocational training for community-based drug rehabilitation and recovery. The township (town) people’s governments and urban neighborhood offices should be responsible for the community-based drug rehabilitation and recovery work. The Regulations on Drug Rehabilitation are divided into two chapters, setting forth the main systems and important content of community-based drug rehabilitation and recovery respectively. In general, the Anti-drug Law and the Regulations on Drug Rehabilitation still emphasize more on the rules concerning the recovery, return, and job employment for drug rehabilitation personnel rather than principles. To better ensure the implementation of the Anti-drug Law and the Regulations on Drug Rehabilitation, it is necessary for the State Council to specially formulate the Regulations on the Recovery, Return, and Job Placement of Drug Rehabilitation Personnel.
