The agency said it provides refunds to its clients if their visa applications are rejected, if they fail to pass through customs or if they have a health problem late in their pregnancy that prevents them from traveling.
There are no regulations in Shanghai that prohibit businesses from helping residents have children overseas, according to a previous report on the news website Eastday.com.
US law also doesn't prohibit foreigners from having a child in the US, nor does it prevent them from entering the country, said Qu Yinghua, an immigration lawyer with the Shanghai Guonian Law Firm.
The US government acknowledged that it is not against the law for a foreign citizen to have a baby while traveling in the country.
"Most expectant mothers who go to the US claim they are going to sightsee. We cannot deny their applications even if we know they will give birth there," a press officer from the US Embassy in Beijing said in an earlier interview with the Oriental Morning Post.
