Yan Yanhong, the 21-year-old kindergarten teacher accused of mistreating her pupils in Wenling, East China's Zhejiang Province, is being held in criminal detention, and local police have asked prosecutors to charge her with a crime, reported the Xinhua News Agency Sunday.
Another teacher, surnamed Tong, who took a photo of Yan lifting a screaming, bawling boy off the ground by his ears, has been released after serving a 7-day administrative detention.
The education bureau of Wenling said on October 24 that Yan, an uncertified teacher, had been with the kindergarten for two years before she was fired.
Yan asked Tong to take the infamous photo of her teaching the 5-year-old boy a lesson more than one month ago.
The photo, posted online on October 24 by a Weibo user and parent named "Jiangjiang," triggered public outrage.
Yan was quoted by the local Wenling Daily as saying that she was only playing with the child.
Tong has said she regretted not stopping or reporting Yan's mistreatment.
Yan's personal blog also contained other photos showing her mistreating children, including taping a child's mouth shut, putting pupils in trash bins, stripping off their pants while dancing and forcing the children to kiss each other.
The official Weibo account of Wenling police pointed out that China does not have a law to specifically deal with child abuse by someone outside the child's family.
The kindergarten was rated as failure in its annual evaluation.
