China to protect electromagnetic environment of fixed military radio facilities

BEIJING, July 24 (ChinaMil) -- The Legislative Affairs Office of the State Council (SCLAO) published The Military Facilities Protection Amendment Act of the People's Republic of China (Exposure Draft) on the China Legislative Information Website (www.fazhixinxi.com) on July 23, 2013.

The exposure draft stipulated that no equipment and electromagnetic obstacles that may affect the performance of fixed military radio facilities shall be constructed or installed within the protected area of electromagnetic environment for fixed military radio facilities, and no activities are allowed to affect the electromagnetic environment of fixed military radio facilities.

The exposure draft emphasized that:

No personnel, vehicles and vessels other than those from the prohibited military zones in land or in waters are allowed to get into military prohibited zones;

No photographing, video recording, audio recording, surveying, measuring, map drawing and description are allowed in the prohibited military zones;

No low-altitude flight is allowed in the sky over the prohibited military zones unless approved by military authorities of the Military Area Command (MAC) level or above.

No construction and installation of non-military facilities and no aquaculture, fishing, or any others that may impede the activity, security and confidentiality of military vessels are allowed in the waters of prohibited military zones.

The exposure draft also stipulated that in the case of serious perpetration that disturbs the prohibited military zones or disrupts the administrative order of the military administrative areas, the ringleader(s) and person(s) with direct responsibilities will be held accountable for criminal liability pursuant to criminal laws and related regulations. In the case of minor perpetration that is short of criminal penalties, the penalty provisions of the PRC Public Security Administration Punishment Laws shall apply.
