Apple’s iPhone6 and iPhone6Plus sued for copyright plagiarism by a Chinese company

Apple may lose its rights to sell iPhone6 and iPhone6Plus in Beijing, after the high-tech giant lost a copyright lawsuit to a Chinese company.

The Shanghai office of Apple Inc, together with China’s mobile e-commerce company Zoomflight Telecom, was sued by a Shenzhen-based company, claiming Apple’s popular models – iPhone6 and iPhone6Plus – have copied the design of its cell phone coded 100C, which has registered intellectual property rights, according to Beijing Morning Post.

The Beijing Intellectual Property Office (BIPO) agreed with the Chinese company’s demand to ask Apple and Zoomflight to stop selling iPhone6 and iPhone6Plus, as the office found Apple’s iPhone6 and iPhone6Plus and the 100C have minor differences that the public will be hard to distinguish, the newspaper reported.

Both Apple and Zoomflight have filed administrative lawsuits against the BIPO in the Beijing Intellectual Property Court and have demanded the office withdraw the decision, arguing that the iPhone6 and iPhone6Plus are not the same with nor do they resemble the 100C, according to Beijing Morning Post.

On Wednesday, the court sent a notice to the BIPO responding to the actions.

If the court rules for the BIPO’s decision, the two models involved in the case – iPhone6 and iPhone6Plus – can no longer be sold in Beijing, said Lu Zhaowen, a Beijing-based lawyer of intellectual property rights.

Since the ruling will be given by a court in Beijing, the judgment will not affect other regions in China. However, it can serve as a precedent for other intellectual property offices elsewhere, Lu told Beijing Morning Post.
