The father and grandparents of an 8-year-old boy filed a lawsuit against the child’s mother after they learned the boy has no blood relationship with them, according to a paternity test.
The parties negotiated a settlement through mediation after a court trial in Shanghai’s Jiading District. The mother will pay compensation of 55,000 yuan (US$8,871) and 45,000 yuan, respectively, to her husband and parents-in-law.
The woman married the man in November 2004 and gave birth to a boy seven months later. They divorced in July 2007. The boy lived with his mother after the divorce and the man paid child support regularly.
The man started to doubt the boy was his at the beginning of this year and he had a paternity test done on January 31. The conclusion confirmed his suspicion. He requested the court to relieve him of paying support and asked the women to return what he had paid, insurance and interest totaling more than 110,000 yuan and compensate him with 20,000 yuan for mental distress. His parents asked for over 190,000 yuan of compensation for maternity hospital fees, banquet fees and jewelry and 10,000 yuan for mental distress.
The woman said she didn’t hide the boy’s parenthood intentionally. She didn’t know the truth until she received the court summons. She said she was willing to compensate the man and his family.
