China Revises Trademark Law

The Ninth National People's Congress has set about revising the trademark law in a move to curb usurpatory registration of trademarks of others.

The trademark authorities are now drafting the amendment to the trademark law. It is reported the amendment would not only lift the ban on the subject of ownership of trademarks, but also establish the system of supervision of justice departments over review of trademark cases, and step up protection of the right of trademarks as well.

China has practiced the principle of application first in trademark registration in the past, in that the trademark belong to the first applicant, which may sometimes lead to unfairness in operation. The amendment will fine-tune the principle to bring unlawful registration of well-established trademarks under control.
