Chinese Court First Time Ruled the Person Guilty for Exercising Overtime Detainment
The people's court of the Baofeng County, Henan Province recently announced the sentence of a case for overtime detainment. Ye Junting, former Brigade leader of Brigade No.7 for Criminal Detection of the Public Security Bureau of Jiaxian County, Henan was ruled a sentence of 6 months under custody for committing the crime of illegal detainment. As learned this is the first time for the people��s court to convict guilty a person who is responsible for the overtime detainment.

On March 12, 2003, there happened in Jiaxian a case of theft for explosives and fuses. The county public security bureau took a villager surnamed Zhao X as a key suspect. In the evening of March 21, Zhao was taken by the aforesaid Ye Junting and some others to the bureau for questioning and the next day saw a legal procedure done for putting Zhao under custody for 48 hours. However, Zhao was released not until March 27 when not any other legal procedure had ever been done afterwards.
The court holds, Ye the accused, as a working personnel of the state, using the right in his hand, deprived illegally the freedom of others. The action he took has already constituted a crime of illegal detainment and so he was sentenced to the above-mentioned sentence. When the case was heard and ruled Ye did not make any appeal to the court above within the legal time limit and now the sentence has entered into force.
