Young boy contracts HIV through blood transfusion, gets 400,000 RMB in compensation

A court in the city of Zhangjiajie ruled in favor of a boy who contracted HIV during his treatment in Zhangjiajie People's Hospital. The court demanded that the parties at fault pay over 400,000 RMB in compensation.

Xiaobao, a 9-year-old student, was run down by a tractor on his way home from school on Jan. 3, 2014. During his treatment at Zhangjiajie People's Hospital, four bags of blood were transfused into his body. After his condition became stable, Xiaobao's mother took him to several other hospitals to repair his urethra, which was damaged in the accident.

On July 8, 2015, Xiaobao was diagnosed as HIV-positive by the Center for Disease Control and Prevention in Hunan province. However, tests showed that Xiaobao's parents were not HIV carriers. Thus, it was concluded that the boy must have contracted the virus from his blood transfusions at Zhangjiajie People's Hospital.

Xiaobao's parents soon filed lawsuits against the hospital, the city's central blood station and the company that provided the blood, demanding a compensation of 1.2 million RMB.

On Oct. 18, the Yongding District People's Court made a ruling, requiring the relevant institutions to pay a compensation totaling over 400,000 RMB. However, unsatisfied with the ruling, Xiaobao’s parents have appealed the decision in a higher court.
