Local Law Worked out for Protection of Olympic Intellectual Property Rights

As reported, Liu Qi, the mayor signed the No.85 Order of Beijing Municipal Government passed and adopted at the 38 session of the Standing Committee of Beijing Municipality for the issuance of the "Regulation of Beijing Municipality in Protection of the Olympic Intellectual Property Rights". The regulation shall enter into force as from the 1st of November 2001 onwards.

The regulation constitutes 17 articles, including the purpose of mapping out the regulation, suitable scope of use and definition, banning on conduct of infringement of the Olympic intellectual property rights, requirement for management of its ads and administrative work in carrying out the protection of the Olympic intellectual property rights. The penalties are to be meted out for any malpractice against the regulation and so on.

In accordance with the regulation any trademark in relation to the Olympic Games, special marks, patent rights, works and other creations including the Five Ring Sign of the Olympic Games, banners, Olympic song and mottoes, and "Olympic", "Olympiad" and Olympic Games and diagrams, the emblem, mascot, names and symbols, songs and slogans as such all belong to the Olympic intellectual property rights, all these shall not be used without authorization during the periods of application for and undertaking of the Olympic Games.

Any malpractice in violation of the regulation and infringement on the Olympic intellectual property rights shall be subject to penalties as meted out by departments concerned, such as with those illegal activities and materials to be banned, sealed up or confiscated and to be destroyed or fined or even responsibility for a crime to be investigated.
