China Regulates Judgment on Patent Infringement

China has documented regulations for the first time on the judgment of patent infringement, said Wang Zhenqing, Vice President of the Beijing

Municipal Higher People's Court, on Wednesday at a working conference.

He noted that a committee of the Beijing Court has discussed "suggestions on judgment of patent infringement (for trial implementation)", and will implement it from Wednesday.

Wang also pointed out that the "Patent Law of the People's Republic of China" which was implemented on April 1, 1985, marked the establishment of China's patent system, and aimed to protect patent rights in accordance with law.

Statistics showed that the Beijing Court had received 773 cases of patent difficulties during the first trial which ran from 1985 to 2000.

"Suggestions on judgment of patent infringement (for trial implementation)" has 129 articles involving various fields of patent infringement judgment.
