US Federal Appeals Court Reverses Microsoft Breakup

A US federal appeals court on Thursday reversed the breakup of Microsoft and ordered that a new judge review the landmark antitrust case.

It marked a major victory for the software giant.

The US Circuit Court of Appeals for the District of Columbia said the "remedy" imposed by trial judge Thomas Penfield Jackson, the breakup of the firm into two separate groups, should be overturned.

The ruling said the case was "seriously tainted" by the judge's conduct and that a new judge should review the case.

"We are therefore constrained to vacate the Final Judgment on remedies, remand the case for reconsideration of the remedial order, and require that the case be assigned to a different trial judge on remand," the court said.
