Taking Persistent, Severe Actions against Illegal Manufacturing and Marketing of Counterfeits
The Second Teleconference, held by the State Council on taking nationwide united actions against counterfeits, called for taking nationwide united actions to further deepen the struggle to severely attack crimes in illegally manufacturing and selling fake and shoddy commodities, this is a new plan for the anti-counterfeit struggle launched under the new circumstance in accordance with the Party Central Committee's decision on taking actions to improve social security and vigorously rectify and standardize the market economic order.
Conscientious implementation of the spirit of this conference and constantly deepening the anti-counterfeit struggle is of extreme importance to fulfilling the strategic goal of rectifying and standardizing the market economic order, to bringing about the sustained, rapid and sound development of the national economy and maintaining the good environment of reform and opening up.
The Party Central Committee and the State Council have always attached great importance to the work of rectifying and standardizing the market economic order, and regarded crackdown on the illegal and criminal activities of manufacturing and selling fake and shoddy commodities as an important part of the effort to rectify and standardize the market economic order. Remarkable, phased achievements have been gained for the series of gigantic anti-counterfeit actions launched in recent years, particularly for the nationwide, united anti-counterfeit action taken since October last year. However, due to complicated historical and social reasons, the situation in regard to the deluge of sham and shoddy commodities has not been fundamentally reversed, fake and shoddy commodities that directly affect people's health, lives and property security, in particular, have not been eradicated. We must soberly see that the anti-counterfeit situation facing us remains very severe and the tasks are extremely arduous. The anti-counterfeit struggle admits of not the slightest slackening, but instead, it must be carried on persistently.
Practice proves that success in the anti-counterfeit struggle requires persistent united Actions. The anti-counterfeit battle covers a wide area, it is not enough by relying merely on the strength of one department or a level of government. A powerful, high-handed situation must be formed that involves the united actions taken by all levels from the central to local governments, from industrial and commercial administration, quality supervision, and departments in charge of trades to public security, judicial organ and armed police departments. Only by making overall planning and taking unified actions can there be strength and can it be ensured that "the net of Heaven has large meshes, but it lets nothing through". Further intensified actions provide a sure guarantee for deepening the anti-counterfeit struggle in the future and for ensuring its success.
To deepen the anti-counterfeit fight and intensifying the attacking force, it is necessary to further give prominence to key points and clearly set targets. Primarily, it is necessary to investigate and deal with fake and shoddy commodities that arouse the general public's strong complaints and affect people's health, personal safety and property security, emphasis is placed on investigating and prosecuting illegal and criminal activities of manufacturing and marketing fake and shoddy goods in the fields of foodstuffs, medicines, means of agricultural production, cotton and the assembling of auto parts into complete vehicles. Special struggles should be waged against these products, with priority rectification being conducted in key areas and major markets. In the process of rectification, special attention should be paid to tackling of major and important cases, severely punishing arch criminals and habitual offenders who are engaged in the illegal and criminal activities of manufacturing and selling fake and shoddy commodities, and sternly dealing with those State functionaries who participate in such activities. We must see to it that five cases placed on file for investigation and prosecution "are not let off", this means not letting off the case with details not yet been clarified; not letting off fake and shoddy commodities whose sources and flow direction yet to be found out; not letting off counterfeit responsible person not yet been prosecuted according to law or discipline; not letting off those who should be transferred to the judicial organ but have not yet been done so; not letting off State functionaries who support or participate in the manufacturing and selling of counterfeits but have not been prosecuted. Only by doing so is it possible to really form a momentum and a deterrent force.
Persevering in fighting counterfeits requires the creation of a high-handed situation for a crackdown at present and, proceeding from the need for long-term peace and stability, bringing about temporary and fundamental solution and comprehensive treatment of the problem. We should conscientiously sum up universal and tendentious problems unveiled in the united anti-counterfeit struggle, study and formulate fundamental policy measures and management methods in accordance with the market law, make full use of legal, economic and necessary administrative means, and establish and perfect the supervision mechanism for market activities; we should quickly sort out local and departmental regulations, rules and documents that contravene State laws and decrees, further improve current laws and regulations, so as to put the anti-counterfeit work on a better legal basis; we should persist in integrating the administration of the country according to law and ruling the country by high ethical standard, while persisting in doing administration according to law and strictly enforcing laws, we should strengthen social professional ethic education featuring honesty and keeping faith, advocate the establishment of a good social mode characterized by observance of law and discipline, engagement in legal business, and getting rich through hard work.
The struggle against the manufacturing and selling of fake and shoddy commodities is an arduous and long-term task. So long as we act according to the State Council's strategic plan for the rectification and standardization of the market economic order, unify thinking, enhance understanding, work in a down-to-earth manner and persevere in doing these, we will certainly be able to win victory for this struggle and make new contribution in creating a better environment for economic development.
