High-Level Overseas Chinese Students Encouraged to Return to Work in China

In an effort to improve the international competitive capacity of China's financial institutions, institutions of higher learning, scientific research institutes and large State-owned enterprises, and to meet the needs for China's entry into the World Trade Organization (WTO), with approval from the Party Central Committee and the State Council, the Ministry of Personnel recently published the Opinion on Encouraging High-Level Overseas Chinese Students to Return to Work in China. This is designed to attract and encourage, in an organized and planned way, high-level overseas Chinese students to return and work in China.

The Opinion calls upon various departments concerned and work units to act in accordance with the principle of "supporting Chinese students studying abroad, encouraging them to return home, and allowing them to come and go freely", guide these personnel to adopt various forms to serve the country, return to work in China and use the skills and abilities they have acquired to serve the motherland and people.

The Opinion clearly defines the category of high-level overseas Chinese students. They refer to students sent by relevant government departments and studying abroad at public funds or students studying abroad at private expenses. These students, after completing their studies abroad, become young and middle-aged high-level operational and managerial personnel, specialized technical personnel, and academic technical bellwethers, as well as other personnel whose patents, inventions or specialized technologies have prospects for industrialization development. These personnel have been engaged in the work of finance, engineering technology, teaching, scientific research and management at foreign financial institutions, transnational corporations, international organizations and famous universities and scientific research institutes and have scored remarkable achievements in their work; and they are badly needed at home.

The State will establish a competitive incentive mechanism hooked up with the returned overseas students' abilities, their contributions to the State and the economic and social benefits they have created. These high-level returned overseas students can participate in the distribution on the strength of their patents, inventions, proprietary technologies and management.

During the period of their tenure of office, these returned overseas Chinese students enjoy the same medical and insurance treatment as do other personnel of the employing unit.

With regard to the selection of high-level overseas personnel, the best qualified will be selected and employed through fair competition; the matter can also be examined and decided by other forms and through appropriate avenues. In compliance with the needs of work and the conditions for the selection of personnel, and within the limit of its management power, the employing unit may employ or appoint them to be leaders of the bank, insurance or securities units or put them at leading posts at large State-owned enterprises, institutions of higher learning, and scientific research institutes or at high-level administrative management leading posts. High-level overseas Chinese personnel who return to work in China may have their long-term or permanent right of residence abroad preserved.
