China to Forbid Early Collection of Taxes

Early tax collection will be forbidden in China according to draft amendments to the law on the administration of tax collection, which was submitted to the ongoing top lawmakers' meeting for approval Friday, December 22.

The draft law reads that tax collecting bodies should not initiate or stop tax collection, or alter the due tax amount at their will. Early or deferred tax collection will also be prohibited.

Some Standing Committee members suggested in the previous deliberation on the draft law that an effective supervising and regulating mechanism should be established for China's tax collecting activities. Responsibilities pertaining to tax collection, administration and checking should be clearly defined and separated. Relevant clauses are added to the draft law on this session's discussion.

Rights to take collecting enforcement and conservatory measures on non-producing tax payers are to be strictly limited to taxation institutions and personnel above provincial level in order to prevent the abuse of the administrative power.
