China to Implement Regulations for Labor Market Administration

The Regulations for Labor Market Administration, the first of such kind in China to fully standardize China's labor market, have recently been announced for implementation.

As stipulated in the regulation the hiring units shall have to present relevant certificates when employing laborers and shall make known the briefings for engaging laborers, issuing want ad, which shall first be verified by social labor security department in order that the job seekers can get accurate and ensured information.

The hiring units should for no reason reject or upraise hiring standards of laborers due to the difference of their sexes, nationalities, races and beliefs in religion. Any illegal means shall be prohibited for hiring companies to take to infringe on interests and rights of the employee.

The regulation requires that the hiring units shall have to enter in records in the labor security department when they are going to employ or dismiss working staffs.

As for the administration of job-brokering agencies the regulation defines that whoever wants to set up agency for job brokering or engage in any such activity shall have to be approved by the labor security department.

The regulation has also made it clear that the public job supply institutions under the management of the labor security department shall provide guidance for employment services free of charge to the jobless incompetent in quest for jobs, offer them labor policy consultations and publicize labor market information. The free service will thenceforth be extended from the laid-off workers, the unemployed who are receiving unemployment allowances to those townspeople who have registered as jobless.

Up to now, more than 20 provinces, autonomous regions and municipalities have launched their regional regulations on labor market administration. The new regulations have been initially worked out by defining and absorbing experiences as proved successful in previous years.
