Gore Attorney Appeals Florida Judge RulingDavid Boies, lead attorney for Democrat Al Gore, said Monday, December 4, that Democrats filed an appeal to a ruling from a Florida judge rejecting Gore's legal challenge to the certified result of the US presidential election in Florida State."They won, we lost. We're appealing, this is going to be resolved by the Florida Supreme Court and I think that will be the end of the matter," Attorney Boies said after the ruling by Leon County Circuit Court Judge N. Sanders Sauls. In his ruling, Sauls dismissed Gore's bid for a recount of thousands of disputed ballots, saying the Democrats had "failed to carry their requisite burden of proof" in the case. Gore attorneys sued one week ago seeking a partial, manual recount in counties where his lawyers contended there were enough hidden votes to overturn the certified Florida result that gave Republican George W. Bush victory by just 537 votes out of 6 million cast in the presidential election. Earlier on Monday, the US Supreme Court set aside a Florida high court ruling last month that extended the deadline for counties to submit their results from manual recounts in the election. The court returned the ruling to the Florida high court for clarification. After the Florida election result was certified on November 26, giving Bush victory in the state by just 537 votes, Gore contested the result in court, seeking a partial, manual recount in counties where his lawyers contend there are enough hidden votes to overturn the result. Both Bush and Gore need the state's 25 electoral votes to win the presidency. |
