Supreme Court Makes Judicial Explanations on Robbery

To facilitate the courts at various levels to make accurate verdicts on robbery cases, China's Supreme People's Court (SPC) has recently made judicial explanations on robbery.

"Indoor robbery", according to the SPC, refers to the fact that the criminal intrudes into someone else's living space, including closed courtyards, herdsman's tents, fisherman's boats, houses or rented houses, to commit robbery. Indoor stealing by means of force or threatening to use force is also regarded as indoor robbery.

As for "robbery in public vehicles", the SPC's explanations state that such robbery includes robbing passengers, drivers and crew in passenger vehicles, such as buses, taxis, trains, ships and planes that are in operation, as well as the act of holding up a public vehicle and then stealing from people in the vehicle.

According to the explanations, "the robbery of banks or other financial institutions" refers to robbing cash, securities of banks or other financial institutions and customers, as well as looting vehicles carrying bank notes.

The explanations also cover "robbery with gun" and "robbery with weapon." The former refers to the criminal using a gun or demonstrating his or her gun to conduct the robbery. The latter refers to the criminal conducting the robbery with guns, explosives and knives that are forbidden by the law to be carried by civilians.
