Measures for Management of Software Products Promulgated
The Ministry of Information Industry recently published the "Measures for the Management of Software Products", in order to strengthen the management of software products and promote the development of China's software industry.
The Measures apply to the operation and management of software products (including both home-made and imported software) within the Chinese territory, but do not apply to the software which are developed and used by units or individuals or developed by entrusted people for their own use.
According to the Measures, the development, manufacture, sales, and import and export of the software shall be conducted in accordance with relevant Chinese laws, regulations and standards. Any unit and individual shall not develop, produce, sell, import and export the software which infringe upon the intellectual property rights of other people, contain computer virus likely to harm the security of the computer system, include the contents prohibited to be disseminated by State regulations, and do not meet China's software standards.
It is clearly stated in the Measures that the Ministry of Information Industry is in charge of the management of the software products of the country. A system of registration and filing on records is introduced for all software products. Those haven't been registered and recorded, or whose registration has been annulled, cannot be sold in China.
