Website Wins Lawsuit Against Publisher

A Shanghai-based website has won a lawsuit against a Beijing publishing house for violation of intellectual property right (IPR).

The website, www.rongshu.com, is one of the largest Internet sites in the world offering original Chinese literary works. Some famed Chinese writers have signed IPR contracts with the website, giving it exclusive rights to publish their works.

The China Society Publishing House, based in Beijing, was charged with publishing five books containing articles from the website.

The case focused on the argument over whether IPR of digitized works is protected by Chinese laws.

Beijing No. 1 Intermediate People's Court announced that the publishing house did violate the rights of the website. The court instructed the publishing house to pay the website for using its articles.

Sources from the court said after the judgment that the intellectual work should be used or transmitted legally in the cyber age. The case has also proposed a new topic for China's IPR protection officials and law enforcement.
