Beijing Court For the First Time Uses Internet For EvidenceThe Beijing Second Intermediate People's Court Monday used the Internet to get and check evidence when hearing an Internet related copyright violation and unfair competition case.The accuser, the tonight.com.cn, said that the accused, three Beijing-based IT companies, violated its copyright by establishing links with its database without permission, and hurt its business by selling their services at a price below cost. The accused argues that the accuser's accusation is lacking in evidence and they did not make any violations. In order to find and check evidence, the judge asked to show the relevant videos and use the Internet, which is believed to be the first time in China for a court to use the Internet as a way of gathering evidence. After Monday's trial the judge decided to continue in this way to the next day. |
