China to Revise Extradition LawA draft on Extradition Law has been submitted to the Standing Committee of the National People's Congress (NPC), China top legislature, for deliberation Monday morning.Hu Kangsheng, deputy director of the Legislative Affairs Commission under the NPC Standing Committee, delivered a explanation on the draft law to the 17th session of the Ninth NPC Standing Committee. The draft law makes specific stipulations on the conditions, the examination procedures, as well as the compulsory measures of extradition. According to the draft law, the conditions for approving extradition includes essentially two factors. The first is that the behavior bringing about extradition requirement is deemed illicit both in China and in the requested country. The second is the punishment given should be at least one year imprisonment. Hu said that the extradition between China and foreign countries should be conducted in accordance with the extradition law, or the extradition treaties between the two countries. |
