China Overrules Shell Company's AppealChina's Trademark Administration has overruled an appeal by the Shell Oil company of the United States against a Chinese company which was alleged to have violated Shell's intellectual property rights.The name "Shell" is the trademark of a drink developed by the Ningbo Native And Live Stock Products Company in east China's Zhejiang province in 1996. In 1998, the US Shell company delivered a paper of objection to China's State Trademark Administration (STA), demanding that the use of the trademark by the Ningbo company be discontinued. The Ningbo company claimed that it was innocent and delivered a document to safeguard its rights. The STA recently decided that the two "Shells" are engaged in producing entirely different products and there is no infringement of intellectual property rights in this case. The US Shell is asking the international trademark jury to make the final judgment. |
