China Protects Legal Rights of MinorsChinese judiciary will, acting strictly in accordance with the relevant stipulations of the Constitution, and the Law of the People's Republic of China on the Protection of Minors, deal heavy blow at any crimes of harming the physical and mental health of minors, prevent the juveniles from committing crimes, punish, educate and redeem juvenile delinquents, legally protect the legitimate rights and interests of minors, provide a favorable environment featuring the rule of law for the healthy growth of children.Sources say that Chinese minors account for one-third of the nation's total population. The Law of the People's Republic of China on the Protection of Minors which officially went into effect on January 1, 1992 and the Law on Prevention of Minors From Committing Crimes effective in November 1999 have offered an all-round and systematic lawful guarantee for the judicial protection of juveniles. In the cases of inheritance, divorce, upbringing, adoption, affirmation of guardians and infringement on minors' personal safety, property and intellectual achievement, and in the administrative procedural cases that involve the minors themselves and relate to their benefits, the judiciary conscientiously safeguards the legal rights of minors in accordance with relevant laws and regulations. Chinese judiciary is actively exploring a juvenile judicial system with Chinese characteristics to strengthen the remedial work relating to juvenile delinquents. Statistics show that the recidivistic rate of juvenile delinquents only makes up 0.35 percent of the total number of juvenile delinquents at present, the figure always remains below 0.1 percent in quite a few places, which demonstrates the marked results China has achieved in redeeming juvenile delinquents.
