Death penalties considered for serious 'gutter oil' crimes

BEIJING, Feb. 23 (Xinhua) -- Chinese authorities said they will implement an intensified crackdown on crimes related to "gutter oil," or cooking oil recycled from restaurant leftovers, vowing to hand down the death penalty for cases that are serious enough.

"Courts must give full consideration to suspects' subjective malignance, the amount of money involved and the harm done to the public and the market when ruling in gutter oil cases. For those deserving death, death penalties must be resolutely given," said a Thursday notice.

Harsh punishments should also be given to government officials and civil servants who fail to fulfill duties related to vegetable oil safety, according to the notice, which was jointly issued by the Supreme People's Court, the Supreme People's Procuratorate and the Ministry of Public Security (MPS).

MPS figures show that police have busted 100 gutter oil manufacturers since August 2011 and arrested some 800 suspects in 135 related cases in a special campaign launched last year.

According to the notice, suspects involved in gutter oil-related cases will be investigated for criminal liability in accordance with regulations on producing unsafe food products.

Yes, extreme punishment should be meted out to reduce such unhealthy and criminal practices. But there will be always others, like drug smugglers, who would challenge the State and risk death penalties in the pursuit of wealth.Arresting and punishing the syndicate bosses would go a long way to deter others. A national campaign to weed out "gutter oil" is needed urgently. China will succeed in stamping out these criminal pursuits.

Killing people that produce or sell gutter oil seems a bit extreme. In the case of murder the death penalty may fit the crime, but not gutter oil

In this case death sentence may be a bit hash on gutter oil culprits, two seggestions here. 1) Penalise the seller and producer of gutter oil compulsory and continue to use gutter oil all their cooking for them to consume. 2) China may have to designate certain restaurant to allowed to prepare food of deep fried and totally ban on the oil soak fish dishes or similar dishes, which comsumed unnecessary wastage of oil. These food outlet or factories must have tight control over the where about of the used oil, and CCTV recorded 24 hours daily as evidence for checking by the health authorithy to trace where the used oil is disposed.
