Shanghai expected to introduce Good Samaritan Law

Protection and rewards for good Samaritans are expected to be written into local law in Shanghai.

The "Shanghai Samaritan Protection and Incentives Ordinance (tentative name)" has been included in the 2012 legislative plan of the Shanghai People's Congress and will be submitted to the Standing Committee for deliberation when conditions permit, according to the meeting of Shanghai People's Congress Standing Committee held on Feb. 14, 2012.

"Although Shanghai already has the Courageous Staff Incentives and Protection Measures and the Shanghai Social Security Comprehensive Management Ordinance, these two laws fall short in respect to the protection for good Samaritans." Last year, during the NPC and CPPCC sessions, 14 NPC deputies, including Bo Haibao, had jointly called for legislation concerning Good Samaritan acts.

In 2011, the coordination and Comprehensive Management office of the Shanghai People's Congress judiciary committee and the Shanghai Institute of Legislation carried out a legislative research for Good Samaritan Law. A feasibility study report for "Shanghai Samaritan Protection and Incentives Ordinance" was released in December, 2011.

Local legislation can also establish recognition and reward criteria, hospital obligations to rescue and pay for the patient first, and a rescue mechanism that features government leadership and social participation, to make sure that heroes are shielded from unfair liabilities for their good Samaritan acts.
