Judge mulls Apple patent case award

A US federal judge has rejected Apple’s demand for a patent award of more than a billion US dollars from its rival Samsung. The District Judge Lucy Koh also denied requests for a new trial to hear Apple’s claims that Samsung unfairly used its technology to market knock-off products.

But the judge upheld the validity of the Apple patents at the center of the dispute. A jury in August found that Samsung "infringed" on six Apple patents to create and market 26 smartphones and computer tablets, awarding Apple 1.05 billion US dollars in damages.

While the judge disagreed with the award amount, she is still considering forcing Samsung to pay a smaller penalty.

Earlier, the judge refused to block sales of the infringing Samsung products in the US, because Apple failed to show consumer demand for the devices was driven by the taken technology.

Samsung contends that only three of the 26 older-generation products are still offered for sale in the US. Apple has filed a new lawsuit contending that Samsung’s current products are also using Apple technology. The Judge scheduled trial on that matter for 2014.
