Unending trademark war between Apple and Proview

Shenzhen Proview Technology and Apple went head-to-head on Wednesday during a heated hearing in Shanghai over the bitter iPad trademark dispute. The result of the hearing was announced yesterday, but the trademark war seems unending.

The People's Court in Shanghai Pudong New Area yesterday rejected Shenzhen Proview Technology Inc.’s request to stop Apple Inc. from selling iPads in the city.

Proview appealed that Apple Inc. should stop the sale of products with iPad trademark, remove relevant store logo, destruct relevant publicity materials and make an apology on media to eliminate the impact and pay 10,000 yuan in compensation for litigation costs.

Apple has argued that it holds the legitimate source to use the iPad trademark, that there is no problem with the sales of the Shanghai Apple trading company.

A lawsuit over the right to use the trademark in China is still under the second instance trial at Guangzhou people's higher court, which is scheduled to hold a hearing on Wednesday.

On April 19, 2010, the Shenzhen Intermediate People's Court accepted Apple’s lawsuit over Shenzhen Proview in an iPad trademark dispute. After three court sessions, a first instance verdict was handed down on Dec. 5, 2011. Apple's claim was rejected. The case will undergo second instance on Feb. 29, 2012.
