China fines first enterprise for Hep. B discrimination

An enterprise in Wujiang, Jiangsu Province was recently fined 700 yuan by authorities for discrimination against Hepatitis B carriers during employee recruitment. It was known that this was the first ever administrative fine relating to Hepatitis B discrimination during employee recruitment in China since the release of the "Regulations on Employment Service and Management" by the Ministry of Labor and Social Security on Aug. 1, 2008.

As a technician with about 10 years of experience, Li Xiaona, who preferred not to be identified by her real name, learned from an online source on April 16, 2010 that Suzhou Suyuan Real Estate Development Company, an affiliate of a state-owned company, was in urgent need of a cost engineer for a project in the Tongli Township of Wujiang, and she was fully qualified for the post. She received an interview notice shortly after sending her resume.

After several rounds of interviews, Li was formally recruited by the company. She received a notice from the company's personnel department informing her to work at the company starting April 19. The personnel department instructed her on April 28 to have a physical check-up at the Wujiang First People's Hospital the following day.

After learning that she was a Hepatitis B carrier, the company informed her on May 24 that her employment contract had been terminated with the excuse that she was ineligible for the post. Facing the questions and inquiries raised by Li, the company finally admitted that her failure in passing the Hepatitis B test was the reason behind the cancellation of the employment contract.

The Wujiang Municipal Human Resources and Social Security Bureau received a letter of complaint on June 25, 2010 about discrimination against Hepatitis B carriers. After confirming the discrimination through investigations, the bureau sent a formal notification that the real estate company owned by COFCO Property (Group) Co. would be levied a 700-yuan penalty on Aug. 5.

Reporters learned that the Wujiang People's Court mediated the discrimination case on Sept. 5, and at last the real estate developer paid Li 3,000 yuan in compensation
