Chinese enterprise to be exempt from anti-dumping tariffs in Europe

The European Court recently ruled that during the final ruling over anti-dumping measures against Chinese-made ironing boards in April 2007, the European Commission (EC)'s approach denying market economy status to a Chinese enterprise, Yongjian Commodities Co Ltd based in Shunde District, Foshan of Guangdong province, and imposing an 18.1-percent anti-dumping tariff on the company was illegal.

This means that Yongjian Commodities will be exempt from anti-dumping tariffs. An official from the Bureau of Fair Trade for Imports and Exports under the Ministry of Commerce (MOFCOM) welcomed this ruling on October 15.

The official said that the market economy treatment issue is an important factor restricting Chinese enterprises from achieving better results in responding to the EU'S anti-dumping investigations. Chinese enterprises said that during recent years, the EC has set increasingly rigorous requirements in terms of technical standards for market economy treatment. It has become increasingly difficult for enterprises to acquire market economy treatment. They called on the EC to objectively and fairly deal with applications from Chinese enterprises for market economy treatment. The European Court's judgment on the illegality of the EC's approach denying the market economy status of a Chinese ironing board enterprise has verified the common call of Chinese enterprises for equal treatment.

The official added that in terms of overseas unfair and unreasonable behaviors in trade relief investigations on Chinese enterprises, the Chinese government encourages related Chinese enterprises to actively utilize relevant national and local judicial systems to effectively safeguard their legitimate rights and interests.
