UN Security Council fails to come to an agreement on Kenya case

The UN Security Council met here Friday on whether or not to grant a deferral to an International Criminal Court (ICC) case against a group of Kenyan officials, but could not agree on the matter, this month's Security Council president said.

Nestor Osorio, the Colombian UN ambassador who holds the rotating Council presidency for April, told reporters that the 15- nation UN body gave the matter "full consideration" before failing to come up with a decision.

"Having received a request from the Kenyan permanent representative for a 12-month deferral of the cases against six Kenyan nationals under Article 16 of the Rome Statute of the ICC and taking into account the position expressed by the African Union (AU), the Security Council held an informal dialogue on March 18 and informal consultation on April 8, 2011 in order to consider the issue," Osorio told reporters here after the Council' s closed-door consultations.

The six Kenyans, known as the "Ocampo Six" stand accused of orchestrating violence in the aftermath of elections held in Kenya in 2007.

A letter from Macharia Kamau, the permanent representative of Kenya to the UN, expressed reasons for the deferral request.

"The deferral would greatly enhance the ability of the country to complete its reform program, including putting in place a local tribunal, in keeping with its primary responsibility to investigate and prosecute cases in accordance with the Rome Statute," the letter said.
