US blames Chinese firms for its own failures (2)

(People's Daily Overseas Edition)

16:18, May 24, 2012

He Maochun attributed it to the declining competitiveness of many U.S. companies, especially those in emerging industries. Interest groups in the United States have taken all possible trade remedy measures to protect increasingly uncompetitive domestic companies. They have pounced on certain issues regarding Chinese companies, and taken advantage of China’s support policy for certain companies to generalize the label “government subsidy recipient” to all Chinese companies in a peremptory way.

“The United States has attributed its own failure to the Chinese government’s providing prohibited subsidy and dumping goods against WTO rules. It is obviously not objective,” Mei said.

The U.S. manufacturing sector has remained sluggish for a long time mainly because of its own problems. The United States thinks it has done nothing wrong, and has strengthened trade law enforcement to solve trade problems, which it believes have all been caused by its trading partners’ unfair trade practices. Protectionism and frequent trade disputes with other countries will make U.S. companies less motivated to improve their own competitiveness, said Mei.

A template for future trade disputes?

When asked whether the ruling will set a template for future trade disputes involving Chinese SOEs, He said that although U.S. courts often follow the doctrine of precedent, it is still too early to draw any conclusion from a legal perspective. It is just an isolated case as part of the normal trade friction between the two countries.

He said that the country should prove in a reasonable and well-founded way that it has fulfilled its WTO commitments by implementing the reform and opening-up policy. Furthermore, the Chinese companies involved should be brave and determined to defend their legitimate rights and interests through lawsuits, instead of relying on the mercy of others.
